General Terms and Conditions
Applicability These General Terms and Conditions apply to all quotations, agreements, and deliveries by acghoodie.com, unless otherwise explicitly agreed in writing. If the customer includes terms or conditions in their order, confirmation, or communication that differ from these General Terms and Conditions (or imply acceptance of such differences), these terms will only bind acghoodie.com if explicitly accepted in writing.
Offer
If an offer has a limited validity period or is subject to conditions, this must be clearly stated in the offer. The offer will include a complete and accurate description of the products and/or services, detailed enough for the customer to properly evaluate it. While acghoodie.com ensures images in the offer truthfully represent the products/services, colors may vary due to the customer’s screen settings. Obvious errors or inaccuracies in the offer shall not be binding on acghoodie.com.
Agreement
Subject to paragraph 4, the Agreement is formed when the customer accepts the offer and meets its specified conditions. If the customer accepts the offer electronically, acghoodie.com will immediately confirm receipt of this acceptance. Until this confirmation is sent, the customer may terminate the Agreement. For electronically concluded Agreements, acghoodie.com will implement appropriate technical and organizational measures to secure data transmission and maintain a safe network environment. For electronic payments, relevant security measures will also be in place. Within legal boundaries, acghoodie.com may verify the customer’s ability to fulfill payment obligations and other factors relevant to responsibly concluding remote agreements. If, based on this assessment, acghoodie.com has sufficient reason not to proceed, it may refuse the order/request (with reasons provided) or impose special conditions on fulfillment.
Right to Withdraw (for Products)
When purchasing products, the customer may terminate the Agreement within 14 days of receiving the order (or their representative receiving it) without providing a reason. During this period, the customer must handle the products and packaging with care. Packaging may be opened and products used only to the extent necessary to decide whether to keep them. If the right of withdrawal is exercised, the customer must return the product—along with all included accessories (where reasonably possible)—in its original condition and packaging, following acghoodie.com’s reasonable, clear instructions.
Cost of Withdrawal
If the customer has made a payment, acghoodie.com will refund the amount as soon as possible, but no later than 30 days after the return or cancellation is processed.
Exclusion of Right to Withdraw
acghoodie.com may exclude the right to withdraw only if this exclusion is clearly stated in the offer, at least in good time before the Agreement is concluded. The right to withdraw does not apply to: – Products that are clearly personal in nature; – Products that cannot be returned due to their inherent nature.
Price
During the stated validity period of the offer, product/service prices will not increase, except for changes resulting from adjustments to VAT rates or other government-imposed taxes. Prices in the offer include VAT. An agreement is only finalized once acghoodie.com accepts the order. acghoodie.com reserves the right to reject an order (with reasons) or impose delivery conditions, unless otherwise explicitly stated. If an order is rejected (e.g., due to prior fraud, credit checks, or blacklisting), acghoodie.com will notify the customer within 2 working days of receiving the order.
Conformity and Warranty
acghoodie.com warrants that products and/or services comply with the specifications, reasonable reliability/availability requirements outlined in the Agreement, offer, and conditions as of the offer date. This warranty is subject to applicable laws and government regulations. Manufacturer or importer guarantees for acghoodie.com products do not affect the customer’s legal rights or claims against acghoodie.com for failures to fulfill obligations under the law or distance contracts. Complaints and comments will receive a response as soon as possible, but no later than 14 days from receipt. If a longer processing time is foreseeable, acghoodie.com will acknowledge receipt within 14 days and specify when a detailed response can be expected.
Delivery and Execution
acghoodie.com will exercise utmost care in receiving, processing product orders, and evaluating service requests. Delivery will be to the address provided by the customer. The website will clearly state delivery methods and timelines before the Agreement is concluded. If no delivery period is agreed or specified, products will be delivered within 30 days. If acghoodie.com cannot meet the agreed delivery period, it will notify the customer. The customer may then agree to a new delivery date or terminate the Agreement free of charge. Accepted orders will be processed promptly, but no later than 30 days (unless a longer period is agreed), in line with Article 4 of these terms. If delivery is delayed, or the order is unfulfillable (in full or part), acghoodie.com will notify the customer within one month of the order. The customer may terminate the Agreement free of charge in such cases but is not entitled to compensation. Unless otherwise agreed, acghoodie.com bears the risk of damage or loss to products until delivery to the customer. For returns, the customer bears this risk until the products are delivered to acghoodie.com.
Payment
Unless otherwise agreed, full payment for orders is required in advance, via online methods (credit card: Eurocard, Visa; or iDEAL), subject to approval by the payment processor. No additional fees apply to online payments. The customer must immediately notify acghoodie.com of any inaccuracies in provided payment details. acghoodie.com accepts VISA and MASTERCARD. For credit card payments, the amount will be deducted immediately upon payment confirmation.
Exchange and Return Procedure
acghoodie.com’s full exchange and return policy is available here (link to details for online store orders). If the customer wishes to return a product for any reason, they may do so within 30 days of delivery. During this period, the customer must handle the product and packaging with care, opening or using the product only to assess whether to keep it. When exercising the right to withdraw, the customer must return the product—with all included accessories (where reasonable)—in original condition and packaging, following acghoodie.com’s instructions. acghoodie.com will refund the paid amount to the customer’s bank account within 14 days of receiving the returned product in good condition, using the same payment method as the original transaction.
Force Majeure
In the event of force majeure, acghoodie.com may suspend or terminate order fulfillment at its discretion, without legal proceedings, by written notice. acghoodie.com shall not be liable for compensation, unless this is unreasonable under the specific circumstances by fair and reasonable standards. Force majeure refers to any event not attributable to acghoodie.com, arising from no fault or liability on its part under law, regulations, or general consensus.
Privacy
acghoodie.com does not sell customer data to third parties. Data is only shared with third parties when necessary for them to perform services on acghoodie.com’s behalf or to comply with legal requirements. See here for the full privacy statement.
Miscellaneous
If a delivery address is provided in writing to acghoodie.com, all orders may be shipped to that address unless written notice of a different address is received. acghoodie.com may temporarily or permanently deviate from these terms (whether by practice or otherwise) without waiving its right to enforce strict compliance. No rights may be claimed based on such flexible application. If any provision of these terms (or other agreements with acghoodie.com) conflicts with applicable law, that provision shall be invalid and replaced with a legally permissible alternative that achieves a similar purpose. Other provisions shall remain unaffected. acghoodie.com is authorized to engage third parties to enforce this Agreement.
Applicable Law and Jurisdiction
All rights, obligations, offers, orders, agreements, and these General Terms and Conditions are governed by law. All disputes between the parties shall be exclusively resolved by the competent courts.
